Official Rules for the Pulse Healthcare Staffing/NurseWeek Summer Getaway Giveaway

NO PURCHASE OR INTERNET ACCESS IS NECESSARY TO ENTER THIS CONTEST

TERM: The Contest will run from 8:00 AM Eastern Standard Time on June 2, 2003 through 5:00 PM Eastern Standard Time, August 31, 2003.

PRIZE: One winner will be randomly selected and upon verification, will receive a $5,000 travel voucher and a $5,000 cash prize.

ODDS OF WINNING: Odds of winning will be determined by the number of entries received.

HOW TO PARTICIPATE IN THIS CONTEST:

ONLY ONE ENTRY PER PERSON WILL BE ACCEPTED.

(a) Signing up for the contest. If you signed up for the contest on the NurseWeek web site (www.nurseweek.com) directly or through a direct link from the Pulse Healthcare Staffing web site (www.pulsestaff.com), you are automatically entered into the Summer Getaway Giveaway, hereinafter referred to as “Giveaway”. All required fields on the contest registration form must be completed in order to be entered into the drawing.

(b) By mail. You may also request an entry form by United States Mail by sending a self-addressed stamped envelope to NurseWeek. Mechanically reproduced entries are not permitted. Mail your self-addressed stamped envelope to: Summer Getaway Giveaway, 1156-C Aster Avenue, Sunnyvale, CA 94086. Mail entries must be mailed to the address above, must be postmarked by August 15, 2003 and received no later than August 31, 2003. Hand-delivered entries will not be accepted. A completed entry form must be sent to NurseWeek in order for you to be registered for the Giveaway.

By registering to win the prize, the winner grants Pulse Healthcare Staffing & NurseWeek permission to use his/her name, photograph, and likeness for advertising and future promotion purposes without additional compensation (except where prohibited by law). This Giveaway is subject to these complete and Official Rules.

Signing up as a registered user of online services from Pulse Healthcare Staffing or NurseWeek. If you signed up as a registered user of www.pulsestaff.com or www.nurseweek.com for services unrelated to the Giveaway, you are not automatically entered into the Giveaway - you must register separately for this contest.

Pulse Healthcare Staffing, NurseWeek, and each of their respective affiliated companies are not responsible for errors, omissions, interruptions, deletions, defects in part or whole, delays in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for any technical or non-technical network, telephonic, electronic, computer, hardware or software malfunctions of any kind, or inaccurate or partial transmission of or failure to receive entry information by NurseWeek and Pulse Healthcare Staffing on account of technical problems or traffic congestion on the Internet, at any web site or any combination thereof. Pulse Healthcare Staffing, NurseWeek, and each of their respective affiliated companies are not responsible for any injury or damage to entrant's or any other person's computer related to or resulting from playing or downloading any materials in the Giveaway, or for mail-in entries that are lost, late, misdirected, damaged, incomplete, altered, illegible or postage-due. All entries become the property of Pulse Healthcare Staffing and NurseWeek and will not be returned. Pulse Healthcare Staffing and NurseWeek reserve the right to cancel temporarily or permanently the electronic method of Giveaway entries if it becomes technically corrupted.

DISQUALIFICATION: Your entries will be disqualified, at the sole discretion of Pulse Healthcare Staffing and NurseWeek if you attempt (i) to enter the Giveaway through any means other than as described in these Official Rules; or (ii) to disrupt the Giveaway, circumvent the terms and conditions of these Official Rules, or in any way tamper with the Giveaway. If either of the above occurs, Pulse Healthcare Staffing and NurseWeek have the right to remedy any such action, disruption, or circumvention, and to seek damages from you to the fullest extent permitted by law.

ELIGIBILITY: The Giveaway is open to U.S. residents in the United States (Excluding Florida, New York, and Rhode Island) who are 18 years or older at the time of entry and who are licensed Registered Nurses (RN license required). By entering this Giveaway, you represent to Pulse Healthcare Staffing & NurseWeek that you meet the above requirements. Employees of NurseWeek, Corporate and Administrative employees of Pulse Healthcare Staffing, and each of their respective affiliated companies, subsidiaries, advertising or promotional agencies, and other agents, and the immediate family members of, and any persons domiciled with, such employees, are not eligible to enter or win.

SELECTION OF WINNER: Winner will be selected in an electronically randomized manner on the afternoon of September 4, 2003. Attempts to contact the winner will begin on the day of the drawing, and the winner has 7 days from the date of notification to contact NurseWeek to claim their prize. Pulse Healthcare Staffing & NurseWeek reserve the right to modify scheduling of the Giveaway without prior notice. If the judges determine in their sole discretion that there is any suspected or actual electronic tampering with the giveaway or if technical difficulties compromise the integrity of the giveaway, the judges reserve the right to void the entries at issue, and/or terminate the giveaway and conduct a random drawing to award the prize using all eligible entries received as of the termination date. Limit one prize per person. Winner will be required to sign and return an affidavit of eligibility and liability/publicity release within 7 days of notification. Failure to return the affidavit in the time noted will result in disqualification of the entry and the random selection of an alternate winner. Pulse Healthcare Staffing & NurseWeek will require the winner to provide proof that they are the authorized holders of the nursing license number(s) used to enter the Giveaway. Any winner who does not comply with the Official Rules will be disqualified and an alternate winner will be selected. Return of any prize or prize notification as "undeliverable" will result in disqualification and an alternate winner will be selected.

NOTIFICATION: Prize winner will be notified by phone, U.S. mail, and/or email using the contact information provided on the entry and Pulse Healthcare Staffing and NurseWeek are under no obligation to notify winner by any means other than as described above. If a winner's contact information (as provided on the entry) is no longer valid, the entry will be disqualified and an alternative winner will be selected. If a prizewinner entered by mail, the notification will be sent to the address that was printed on the mail in entry. Pulse Healthcare Staffing and NurseWeek are not responsible for notifications that are misdirected or not received because of e-mail addresses or mailing addresses that are no longer correct. If a potential winner cannot be reached after a reasonable effort has been made during 7 days from the first notification attempt, such person may be disqualified, with an alternate winner selected. Any prize notification or prize returned as undeliverable will result in the awarding of that prize to an alternate winner.

REDEMPTION: Pulse Healthcare Staffing & NurseWeek will deliver the prize as follows: The cash prize and travel voucher will be hand delivered within 60 days of verification of a valid winner. Prizes are non-transferable. Pulse Healthcare Staffing and NurseWeek also reserve the right to award a prize of equal or greater value if the advertised prize is unavailable.

CONDITIONS: By participating in the Giveaway, you agree to release and hold Pulse Healthcare Staffing and NurseWeek, and its directors, officers, employees and agents, and all prize suppliers harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with the Giveaway or any product purchased, or resulting from acceptance, possession, use or misuse of any prize, including, without limitation, personal injuries, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy, whether suffered by you or a third party. The use of information provided by entrants shall be governed by the privacy policy for the sweepstakes, identified on the entry form screen. This Giveaway is void wherever prohibited or restricted by law and is subject to all applicable federal, state and local laws and regulations. By participating, entrants agree to be bound by these Official Rules and the decisions of Pulse Healthcare Staffing & NurseWeek, and waive any right to claim ambiguity in the Giveaway or these Official Rules. All decisions regarding the Giveaway, including, but not limited to, selecting winner, will be made by Pulse Healthcare Staffing & NurseWeek, whose decisions shall be final. Winner is solely responsible for all applicable federal, state and local taxes and fees. By entering this contest, you give Pulse Healthcare Staffing and NurseWeek permission to use your contact information (including postal addresses, phone numbers, and email addresses) to send you updates and offers.

NOTIFICATION OF PRIZE WINNER: The name and/or photo of the winner of the Giveaway will be published in the edition(s) of NurseWeek following winner notification and verification.
