NurseWeek.com has no control over, nor creates any of the Clinical Library database information provided for access to its users on its website. All Clinical Library database information is provided by Mosby's Drug Consult, and Mosby's Drug Consult alone controls and creates the content of the Clinical Library database. BY ACCESSING AND USING THE CLINICAL LIBRARY DATABASE LOCATED ON NURSEWEEK.COM USER ACKNOWLEDGES THAT THE INFORMATION DOES NOT COME FROM, NOR IS IT ENDORSED AND/OR APPROVED OF IN ANY WAY BY NURSEWEEK.COM, AND BECAUSE OF THIS ACKNOWLEDGEMENT USER AGREES THAT NURSEWEEK.COM, ITS PARENT COMPANY, NURSEWEEK PUBLISHING, AND ANY OTHER COMPANY AND/OR BUSINESS OWNED BY NURSEWEEK PUBLISHING AND/OR NURSEWEEK PUBLISHING'S AFFILIATES, RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES AND INFORMATION PROVIDERS BEAR NO RESPONSIBILITY OR LIABILITY FOR THE INFORMATION PROVIDED IN THE CLINICAL LIBRARY DATABASE.

NurseWeek.com ("Accordant") provides access to CLINICAL LIBRARY produced by Mosby's Drug Consult. Although Mosby's Drug Consult makes reasonable efforts to ensure the accuracy and reliability of CLINICAL LIBRARY, USER acknowledges that Accordant, its affiliates, and their respective officers, directors, employees and information providers and Mosby's Drug Consult, its affiliates, and their respective officers, directors, employees and information providers will not be held liable for any damages suffered or incurred by USER or any third person arising out of: a) any faults, interruptions or delays in CLINICAL LIBRARY or its delivery, b) any use of or reliance on CLINICAL LIBRARY by any person, or c) any inaccuracies, errors or omissions in CLINICAL LIBRARY, irrespective of however such faults, interruptions, delays, inaccuracies, errors or omissions arise unless due solely and exclusively to the negligence or willful misconduct of Mosby's Drug Consult. Both Mosby's Drug Consult and Accordant shall not be liable to USER for any loss, cost or damages resulting from any delays in delivery and/or non-delivery of the content. USER acknowledges that its sole and exclusive remedy in the event of such delay is to not accept this Agreement. Mosby's Drug Consult does not represent or warrant that Clinical Library will meet the objectives or needs of USER or any third party. Mosby's Drug Consult makes no warranty of merchantability of CLINICAL LIBRARY or of the fitness of CLINICAL LIBRARY for any purpose. UNDER NO CIRCUMSTANCES WILL Mosby's Drug Consult OR ACCORDANT BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY CLAIM OF LOST INCOME OR PROFITS, IN ANY WAY ARISING OUT OF OR RELATED TO THIS AGREEMENT, EVEN IF ACCORDANT AND/OR GSM HAVE BEEN ADVISED AS TO THE POSSIBILITY OF SUCH DAMAGES .
